New Zealand New Visa Rules for Foreign Workers

New Zealand has implemented changes in its visa regulation process impacting foreign workers, their spouses, and children as of 26 June 2024. This new set of rules is intended to simplify and align with the country’s economic and immigration policies in visa issuing.
The main modification is that if a person works under the Accredited Employer Work Visa (AEWV) at Australian and New Zealand Standard Classification of Occupations (ANZSCO) skill levels 4 and 5 without the possibility of gaining residence permission, their partner and dependent children cannot obtain work, visitor, or student visas for New Zealand. This adjustment makes the AEWV scheme resemble the previous Essential Skills Work Visa programme.

However, it is noted that the children can apply for an Accredited Employer Work Visa or international student visa by meeting the eligibility criteria.

Additionally, the change will not impact:

  • People who already possess visas as a partner or a dependent child or Accredited Employer Work Visa (AEWV) holders working at levels 4 and 5 of Australian and New Zealand Standard Classification of Occupations (ANZSCO) with residency rights, such as those on the Green List or under a sector agreement with a residence pathway.
  • Those earning at least 1.5 times the median wage in New Zealand for the Skilled Migrant Category.
  • Those with ongoing applications for partnership or dependency will also not be affected.
  • These applications will be evaluated based on the standards that were in existence on the day the applicants submitted their applications.
